Terms and Conditions of Sale of Admission Tickets to the Musei Civici di Cremona

1. SUBJECT OF THE CONTRACT AND DEFINITIONS

This contract governs the sale of admission tickets (hereinafter "Tickets") for entry to and use of the museum services, exhibitions and events organised at the Musei Civici di Cremona (hereinafter the "Organiser" or "Municipality of Cremona" (Comune di Cremona). Online sales and sales through digital channels are managed via the Software as a Service (SaaS) technology infrastructure called "dPass" (including the dTicketing/dBooking modules), owned and supplied by DOMNIA S.R.L., with registered office at Via Retrone 16, 36077 Altavilla Vicentina (VI), VAT no. and tax code 03998330249 (hereinafter the "Service Provider"). For the purposes of these terms:

Purchaser/User: the person who purchases the Ticket.

Admission Ticket/Ticket: the document, including in digital format (QR Code), issued through the dPass system, which entitles the holder to enter the Musei Civici.

2. PURCHASE PROCEDURE AND ACCEPTANCE OF THE TERMS

Tickets are purchased online after registering or entering the required details on the official booking portal of the Musei Civici di Cremona. By completing the purchase procedure, the Purchaser declares to have read, understood and fully accepted these Terms and Conditions of Sale. Every transaction is subject to real-time availability checks by the dPass system.

3. TICKET PRICES AND SERVICE FEES

Ticket prices (including any reductions or free admissions provided for by the municipal regulations in force) are shown on the official website when selecting the date and time of the visit. Payment is collected by DOMNIA S.R.L., acting as payment manager through a PSP, via its own account on the Stripe payment platform, and DOMNIA S.R.L. retains a handling fee for the service provided. The Ticket price and any fee applied are shown separately in the cart summary before payment is completed.

4. PAYMENT METHODS AND TRANSACTION SECURITY

Tickets are paid for through the Stripe payment gateway, integrated into the dPass platform and operating on the account of DOMNIA S.R.L. as payment manager through a PSP, using credit/debit card networks, digital wallets or other payment methods enabled from time to time. Payment card data are collected directly by Stripe in accordance with its own security standards (PCI-DSS certification) and are neither stored nor otherwise processed by DOMNIA S.R.L. or the Comune di Cremona.

5. ISSUE AND DELIVERY OF TICKETS

Once the transaction has been successfully completed, the Purchaser will receive a confirmation email at the address provided during purchase. The digital Ticket (containing the identifying barcode or QR Code generated by the dPass software) will be attached to the email or available in the User's wallet. Printing the Ticket is not required to enter the Museums: the QR Code can simply be shown on the screen of a smartphone or mobile device at the entrance gates.

6. EXCLUSION OF THE RIGHT OF WITHDRAWAL AND NON-MODIFIABILITY OF TICKETS

Pursuant to Article 59(1)(n) of Legislative Decree no. 206 of 6 September 2005 (Consumer Code), the right of withdrawal does not apply to contracts for services related to leisure activities if the contract provides for a specific date or period of performance. Therefore, once the purchase has been completed, it is not possible to cancel the transaction, request a refund or change the date and time of the booking, unless specific exceptions are authorised by the Organiser.

7. CANCELLATIONS, POSTPONEMENTS AND REFUNDS

In the event of extraordinary closure of the Museums, suspension of services or cancellation of exhibitions/events due to force majeure or to organisational decisions of the Comune di Cremona, the Organiser will specify how and when the visit may be rescheduled or the face value of the Ticket refunded. Online service fees and ancillary costs are non-refundable in all cases. The Service Provider (Domnia S.r.l.) is not liable for schedule changes or cancellations decided by the Comune di Cremona.

8. ADMISSION RULES AND CONDUCT INSIDE THE MUSEUMS

The Ticket is valid only for the day, time and museum venue stated on it. Access control and QR Code validation are carried out by fixed or handheld optical readers connected to the centralised dPass system. Admission is subject to compliance with the internal regulations of the Musei Civici di Cremona (e.g. bulky items are not allowed, visitors must behave appropriately and respect the works of art). Security staff reserve the right to refuse entry to, or remove, anyone who breaches these rules.

9. LIMITATION OF LIABILITY

Domnia S.r.l., as provider of the dPass technology platform in SaaS form and as payment manager through a PSP via its own Stripe account, is liable to the Purchaser for the correct operation of the payment process and the issue of the transaction receipt. Domnia S.r.l. is not responsible for visitor flow management, the quality of stewarding services, opening hours or any logistical disruption at the exhibition venues, which remain the sole responsibility of the Comune di Cremona. Likewise, neither Domnia S.r.l. nor the Comune di Cremona is liable for temporary malfunctions of the internet or of the user's devices preventing the electronic Ticket from being correctly received or displayed, nor for delays or interruptions attributable to the payment service provider Stripe.

10. INTELLECTUAL PROPERTY

All copyrights, registered trademarks and any other intellectual property rights in the materials or content presented as an integral part of the website biglietteriamusei.comune.cremona.it are owned by the Comune di Cremona and/or by those who have licensed their use. Unless otherwise expressly provided for in these terms, the Comune di Cremona grants no right to use such material. This shall not prevent use of this website to the extent necessary to complete the purchase of Admission Tickets.

11. PROCESSING OF PERSONAL DATA (PRIVACY)

Personal data provided by the Purchaser during the purchase procedure are processed in full compliance with Regulation (EU) 2016/679 (GDPR) and applicable national legislation. The Comune di Cremona acts as Data Controller, while Domnia S.r.l. processes the data necessary for the technical provision of the ticketing service as Data Processor, adopting all appropriate security measures to protect users' confidentiality.

12. GOVERNING LAW AND JURISDICTION

This contract is governed by Italian law. For any dispute concerning the validity, interpretation, performance or termination of these Terms and Conditions of Sale, if the Purchaser is a consumer, mandatory territorial jurisdiction lies with the court of the place of residence or domicile of the consumer. In all other cases, the Court of Cremona shall have exclusive jurisdiction.

13. DATE OF LAST UPDATE

The Comune di Cremona reserves the right to amend and update these General Terms at any time. These General Terms were last amended on 1 October 2026.
